These terms are the agreement between you and Balanced (the "Developer", "we", "us") for the use of the app "Learn French Offline: Ascend" (the "App"). By installing or using the App you accept them. If you do not accept them, please do not use the App.
The App teaches French through lessons, native audio, and spaced-repetition review. It is an educational tool. We do not promise any particular exam result, score, level, or immigration outcome, and the App is not affiliated with, endorsed by, or approved by any examination body or government authority, including those that run the TEF, TCF, or DELF examinations. References to those examinations describe what the App helps you practise, nothing more.
You may use the free part of the App without paying and without an account. Today the free tier includes the first climb, the free level check, one sentence mine, and your daily spaced-repetition review, which stays free. We may change what is included in the free tier for new content, but we will not take away access to content you have already paid for.
Purchases are made through Google Play, so refunds are governed by Google Play's own refund policy and are requested from Google, not from us. We do not operate a separate money-back guarantee. Where the law of your country gives you additional rights to cancel or be refunded, those rights apply and nothing here limits them.
An account is optional and is only needed for the online leaderboard and for syncing your progress between devices. Your learning data lives on your phone. Keeping a copy of your own device and its backups is your responsibility; we cannot recover progress from a device we never received data from. What we do with any data you do send us is described in our Privacy Policy.
Please do not: use the App in a way that breaks the law; attempt to gain access to paid content without paying for it; interfere with, overload, or reverse engineer the App or the services behind it; submit content through the sentence-mining feature that is unlawful or that you have no right to use; or submit a display name to the leaderboard that is abusive or impersonates someone else. We may remove a leaderboard entry or suspend access to online features if this happens.
The App, its lessons, its audio, its artwork, and its name belong to us or to our licensors and are protected by copyright. You get a personal, non-transferable licence to use the App for your own learning. You may not copy, resell, or redistribute its content.
The core of the App works offline, but the optional online features (leaderboard, sync, sentence mining, purchases) depend on services we do not control and may be unavailable at times. We may add, change, or withdraw features. If we ever have to withdraw a paid feature entirely, we will say so in advance in the App.
The App is provided "as is". To the extent the law allows, we do not give warranties that it will be uninterrupted, error free, or fit for a particular purpose, and our total liability to you for any claim connected with the App is limited to the amount you paid us for it in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
The App is not directed to children under 13. If you are under the age at which you can agree to these terms on your own in your country, you need your parent or guardian to agree to them for you.
You may stop using the App at any time by uninstalling it. We may end this agreement if you seriously or repeatedly breach section 6. Ending the agreement does not by itself entitle you to a refund of a period already paid for.
If these terms change, we will update the date at the top of this page. Continuing to use the App after a change means you accept the updated terms.
These terms are governed by the laws of Bangladesh, and the courts of Bangladesh have jurisdiction, except where the law of the country you live in gives you the right to bring proceedings in your own local courts.
